Introduction

These terms and conditions govern the use of the www.kiteuser.com website and application (referred to as "Kite" or "the Developer") and all its content, services, and products. Your use of our Services is subject to your acceptance of all the terms and conditions stated herein, as well as any other operating rules, policies (including Kite’s Privacy Policy), and procedures that may be published by Kite from time to time (collectively, the "Agreement"). By using Kite, you agree to automatic upgrades of our Services, with these terms continuing to apply to any upgrades.

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the https://www.kiteuser.com website or any other product offered ("service") by Kite ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

To access our Services, a Kite account is necessary. Upon registration, you agree to provide accurate and complete information. You are solely responsible for any activity under your username and must ensure the security of your password.

Termination

We will terminate or suspend access to our Service immediately if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Cancellation and Refund

You may cancel the subscription at any point of time by writing to us at support@kiteuser.com. Once your subscription is cancelled, you can still use all the features of the paid plan until the end of the current billing cycle. We do not offer refunds for the payments that are already processed. After cancellation, we will not charge you any payments from the next billing cycle.

Limitation of Liability

The user acknowledges and accepts that the use of the website, our chrome extensions and the service is at the user's own risk and under the user's responsibility. Therefore we do not accept any responsibility for misuse or use in breach of these Terms. The user will be responsible for any damages to Kite resulting from the user's use of the Website, the extensions and the service in breach of the Terms. We do not warrant the availability or continuity of the website, the extensions or the service, its accuracy, reliability or completeness, or whether they are fit for a particular purpose.

Subscription Term and Renewal; Fees and Billing

• Unless terminated earlier in accordance with this Agreement, depending on your preferences when ordering the Services, the subscription period for the Services is either month-to-month or 12 months from and including the date that the Services commence under this Agreement (the “Initial Term”). Upon expiration of the Initial Term and any Renewal Term, your subscription for the Services will automatically renew for additional periods having the same length as the Initial Term (each a “Renewal Term”), unless either of us notifies the other no less than 15 days before the end of the Initial Term or any Renewal Term that your subscription to the Services will not renew. The Initial Term and all Renewal Terms are collectively referred to as the “Term.”
• By subscribing to the Services, you agree to pay the applicable subscription fees as selected by you when ordering the Services, plus any applicable taxes (the “Subscription Fees”).
• We reserve the right to increase the Subscription Fees at the end of the Initial Term and any Renewal Term.
• The Subscription Fees are due and payable either monthly or annually in advance, depending on the preference you selected when ordering the Services.

Price Changes

We reserve the right, at our sole discretion, to modify or adjust our pricing structure for our services and products at any time without prior notice. By continuing to use our services or products after any price changes take effect, you agree to be bound by the updated pricing structure.

Responsibility of users

Kite cannot review all user-generated content, including software, posted on our Services, and therefore, we are not responsible for its content, use, or effects. Our operation does not imply endorsement or accuracy of posted material. Users should take precautions to protect themselves from harmful content. Some content may be offensive or contain errors, and may violate third-party rights or require additional terms. Kite disclaims responsibility for any harm resulting from the use or downloading of content posted on our Services.

In using the Services, you shall not: (i) violate any applicable international, federal or state laws, regulations or rules or any securities exchange requirements (collectively, "Laws"), including by using any Information in a manner that violates the U.S. CAN-SPAM Act of 2003, as such statute may be amended from time to time; (ii) Make any Information available to us if doing so would violate any applicable Laws, industry or professional codes or standards, contractual or fiduciary obligations, confidentiality obligations, or employer policies or other requirements to which you are bound; (iii) Transmit any information, data, images, or other materials that are unlawful, harmful, threatening, harassing, libelous, defamatory, vulgar, obscene or otherwise objectionable or that may invade another's right of privacy or infringe any intellectual property right, including patent, trademark, service mark, trade secret, copyright or other proprietary rights of any third party; (iv) Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; (v) Violate or attempt to violate the security of any of the Services, including: logging in to a server or account that you are not authorized to access; attempting to test, scan, probe or hack the vulnerability of the Site or any network used by the Site or to breach security, encryption or other authentication measures; or attempting to interfere with the Site by overloading, flooding, pinging, mail bombing or crashing it; (vi) Reverse engineer, decompile or disassemble any portion of the Services; or (vii) "Scrape" information from the Services, or use or attempt to use any engine, software, tool, agent or other device or mechanism (including browsers, spiders, robots, avatars or intelligent agents) to navigate or search any portion of the Site, other than the search engine and search agents available from us on the Site and generally available to third party web browsers (e.g., Mozilla Firefox, Google Chrome and Microsoft Internet Explorer).
